JUSTICE SANJAY KUMAR ORAL ORDER 15-12-2017 This writ application has been filed for setting aside the order dated 06.07.2013 passed by learned Principal Judge, Muzaffarpur in Matrimonial Case No.157 of 2011 whereby and whereunder the application filed by respondent under the provision of Section 13 of the Family Court was allowed.
2. Heard learned counsel for the petitioner and perused the record.
3. It appears that the learned court below as per impugned order dated 06.07.2013 permitted the respondent to engage a lawyer to conduct his case. It has been submitted that the respondent before this Court had filed the aforesaid matrimonial case under Section 12 (C) of the Hindu Marriage Act. In the said case the learned court below allowed the prayer of the husband
Patna High Court CWJC No.18718 of 2013 (2) dt.15-12-2017 (respondent before this Court) considering the fact that the wife (petitioner before this Court) was also allowed to engage lawyer. The order permitting the husband (respondent) to engage lawyer does not suffer from illegality requiring any interference.
4. In view of above facts and circumstances, I do not find any merit in this application. Accordingly, this writ application is dismissed.
