The petitioner apprehends his arrest in a criminal prosecution registered under Sections 323, 341, 504 of the Indian Penal Code as also under Section 3(1)(v)(x) of the SC/ST (Prevention of Atrocities) Act, 1989.

Taking into consideration the nature of allegation as disclosed in the FIR vide Annexure-1 as also taking into consideration the bar created under Section 18 of the aforesaid 1989 Act, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for anticipatory bail in connection with Piro P.S. Case No.242 of 2014 pending in the court of learned Chief Judicial Magistrate, Bhojpur at Ara is rejected. The petitioner, if so advised, may surrender in the court below within a period of four weeks from today and, if he applies for regular bail, the same shall be considered on its own merits without being prejudiced/influenced by the rejection of the present application.
