28-01-2015 Heard learned counsel for the petitioner. None appeared on behalf of the State.

This is second attempt for grant of bail to the petitioner in connection with Dhaka P.S. Case No.208 of 2011 registered for the offence under Sections 120(B), 302, 34 of the Indian Penal Code and 27 of the Arms Act. Earlier, by order dated 01.10.2013, the prayer for bail was rejected vide Cr.Misc.No.29030 of 2013. In this case, earlier a report was called for regarding stage of the case, which has been received and kept at Flag-A. On perusal of the report, it appears that after framing of charge, summons have been issued, however, till date no witness has been examined. In view of facts and circumstances, let petitioner Amit

No.38791 of 2014 (3) dt.28-01-2015 2/2 Singh @ Kanhaiya Singh be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Sikrahana, East Champaran at Motihari in connection with Dhaka P.S. Case No.208 of 2011 with conditions that (i) one of the bailors must be blood relation of the petitioner and (ii) during trial, the petitioner shall remain physically present in the court on each and ever date. If continuously on two dates, he fails to appear before the court without prior permission of the court, his bail bond shall stand automatically cancelled.
