2. The petitioner has preferred this application for grant of regular bail in connection with Kursela P.S. Case No. 19 of 2025 registered for the offences punishable u/s 191(2), 191(3), 190, 109, 352, 351(2) of the B.N.S. and Section 27 of the Arms Act.

As per the prosecution case, on 19.01.2025 at about 01:30 P.M., the informant received information from villagers that two groups of miscreants were firing at each other due to rivalry for dominance and a land dispute. For verification of the same, the informant reached there and on seeing the police party, all the miscreants started fleeing away. On being asked,

Patna High Court CR. MISC. No.59146 of 2025(2) dt.27-08-2025 2/3 villagers disclosed the names of miscreants and accordingly, the present F.I.R., has been lodged.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case as being member of one of the groups. It is further submitted that no specific allegation of firing is levelled against the petitioner. It is further submitted that in the alleged firing, of the both the sides, no one from either side sustained any injury and no empty cartridge was recovered from the place of occurrence. It is also submitted that similarly situated coaccused person has already been granted bail by a co-ordinate Bench of this Court vide order dated 14.07.2025 passed in Cr. Misc. No. 42929 of 2025. The petitioner has five criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 21.04.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case and also considering the fact that no one sustained injury in the alleged firing as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand)

Patna High Court CR. MISC. No.59146 of 2025(2) dt.27-08-2025 3/3 with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar, in connection with Kursela P.S. Case No. 19 of 2025, with a condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.

7. The application stands allowed.
