This is third attempt for grant of bail on behalf of the petitioner in connection with Chhatauni P.S. Case No. 69 of 2015 registered for the offence under Section 307, 326/ 34 of the Indian Penal Code, Section 27 of the Arms Act and subsequently Section 302 of the Indian Penal Code was added. Earlier prayer for bail of the petitioner was rejected both on merit as well as on the fact that petitioner was accused in about 20 cases relating to serious offences .
In this case by order dated 29.03.2017 a report was called for from the court below regarding stage of the case which
Patna High Court Cr.Misc. No.12656 of 2017 (3) dt.26-04-2017 2/2 has been received and kept at flag 'A'. The report dated 10.04.2017 shows that earlier due to non -appearance of some accused persons charges were not framed. However, finally on 16.03.2017 charge against five accused persons has already been famed and witnesses were summoned. In the charge sheet about 11 persons have been cited as prosecution witnesses and out of them one witness has already been examined. The learned trial court has also indicated that this case is being proceeded on day to day basis.
Considering the report which suggests that trial has commenced, there is no reason to review my earlier order. Prayer for bail again stands rejected.
