JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2019 This application, for grant of anticipatory bail, arises out of Giriyak (Giriak) P.S. Case No. 184/2019, disclosing offences under Sections 341, 324, 379, 307, 504, 427 and 34 of the Indian Penal Code.
Prosecution case is that while the informant was returning after attending natural, call co-accused Ranjit Bind abused and assaulted him on his head causing injury to him, thereafter, he also called his family members including petitioners, who also assaulted the informant and co-accused Ranjit Bind snatched golden chain from the informant. Submission of learned counsel for the petitioner is that they have falsely been implicated in this case and no
Patna High Court CR. MISC. No.56498 of 2019(2) dt.05-09-2019 2/2 specific allegation has been attributed to him and although, there is allegation of assault, however, the injuries sustained by the informant was found simple in nature.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Nalanda at Biharsharif, in connection with Giriyak (Giriak) P.S. Case No. 184/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
