JUSTICE SANJAY KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

The petitioner seeks regular bail in connection with G.B. Nagar P.S. Case No. 61 of 2016 registered for the offences punishable under Sections 272, 273, 308 of the Indian Penal Code and Section 47(A) of the Excise Act.

The allegation is that 30 liters spirit was recovered from the house of this petitioner.

Learned counsel for the petitioner submits that the liquor in question was recovered from house of the joint family of this petitioner not from the possession of the petitioner. Learned counsel for the petitioner further submits that the petitioner was neither arrested from the place of occurrence nor any incriminating articles have been recovered from the

Patna High Court Cr.Misc. No.5564 of 2017 (2) dt.07-02-2017 2/2 conscious possession of the petitioner and the petitioner is in custody since 19.12.2016, having no criminal antecedent. Considering the period of custody of the petitioner as well as facts and circumstances stated above, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with G.B.
