This is an application for bail in connection with Sugauli P.S.Case No. 19 of 2013 registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that petitioner is husband of the deceased and the prosecution case is false and concocted as the informant has filed an affidavit before the court below to that effect and petitioner is in custody since 18.11.2016.
Heard learned APP also, who has opposed the prayer for bail on the ground that there is allegation of demand and dowry and concealing of dead body after death and marriage was
Patna High Court Cr.Misc. No.8264 of 2017 (4) dt.03-04-2017 2/2 solemnized just one year ago.
Having heard both sides and considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner.
However, learned trial court is directed to expedite the trial of the petitioner and the petitioner may renew his prayer for bail after examination of the informant in this case before the court below itself, who will consider the prayer of the petitioner on the basis of the materials available on record at that time. Accordingly, this application is dismissed at this stage.
