The petitioner seeks bail in Complaint Case No. 357/2014, registered for the offences punishable under Section 498A of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is the husband of the complainant. The petitioner was granted provisional bail vide order dated 02.09.2015 passed in Cr. Misc. 41706/2015, but wife of the petitioner again filed Pupri P.S. Case No. 239/2015 under Sections 498A, 323 and 504 of the Indian Penal Code. After lapse of one year, the provisional bail of the petitioner was not confirmed, as the petitioner did not fulfill

Patna High Court Cr.Misc. No.11162 of 2017 (2) dt.10-03-2017 the conditions on which he was granted provisional bail. The petitioner did not take his wife to his own house. It is submitted that the wife of the petitioner does not want to live with the petitioner and petitioner is in jail since 07.01.2017. Considering the facts aforesaid and the fact that the petitioner being the husband of the complainant remained in jail for about two months and the wife has lodged another case being Pupri P.S. Case No. 239/2015 under Section 498A and other Sections of the Indian Penal Code, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Pupri P.S.
