2. The petitioner apprehends his arrest in a case registered for the offence under Sections-115(2), 126(2), 303(2), 109, 352 and 3(5) of B.N.S., 2023.
3. As per prosecution-story, the informant alleged that on 27.11.2024 all the F.I.R. named accused persons, in inebriated condition, came to the house of the informant and asked about Nitesh Kumar. Upon showing ignorance, allegation is of assault and snatching of Gold chain/mobile phone.
4. Learned counsel for the petitioner submits that allegation of assault is general and omnibus in nature. Injury sustained by the injured is simple in nature. Co-accused
Patna High Court CR. MISC. No.61968 of 2025(2) dt.11-09-2025 2/2 Awadhesh Giri has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 12.05.2025. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the nature of injury, grant of anticipatory bail to the co-accused and clean antecedent, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Saran at Chapra, in connection with Manjhi P.S. Case No. 378 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
