1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 504, 506 and 34 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that petitioners have antecedent of one case but then they were acquitted in the said case and the informant alleges that Prithvi Chandra Giri was taunting his nephew and on objection all the accused persons including the petitioners started assaulting him by rod and danda and when the informant tried to save him accused Prithvi Chandra Giri and Hariom Giri indiscriminately assaulted him by dab causing three injuries on his head. On alarm, people gathered and both the injured were taken to the hospital.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of assaulting the informant is against Prithvi Chandra Giri and Hariom but then as far as assaulting the nephew of the informant is alleged, the allegation is general and omnibus in nature.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Taraiya P.S. Case No. 214 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
