JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 222 of 2019, registered for the offences punishable under Sections 147, 149, 341, 323,379, 406, 420 of the Indian Penal Code.

Prosecution story as per FIR is that mother of the informant had given Rs.14,00,000/- to mother of the petitioner for execution of sale deed with respect to a piece of land but after payment of Rs.14,00,000/- sale deed was not executed and when informant went to inquire into the same he was assaulted.

No.57323 of 2019(2) dt.11-09-2019 2/2 Submission of the learned counsel for the petitioners is that FIR itself shows that Rs.9,00,000/- has been returned and three cheques of three lacs each has been given to the informant for the rest of the amount and the matter has been compromised also.

In view of the above facts and circumstances, let petitioners, above named in the event of their arrest or surrender before the Court below within two weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Bhagalpur in connection with Nath Nagar P.S. Case No. 222 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
