JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-09-2019 This application, for grant of anticipatory bail, arises out of Rajoun P.S. Case No. 25 of 2019, disclosing offences under Sections 379, 411, 420, 467, 468, 471, 120(B) of the Indian Penal Code.

Petitioners happen to be driver and owner of the truck, on which, 100 CFT sand was found loaded and on being asked to show the challan, a fake challan was produced. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and they have the valid challan and ready to produce the same as and when reaquired.

Heard learned A.P.P. also.

No.56630 of 2019(2) dt.06-09-2019 2/2 Having heard both sides, in view of the above facts, this application is disposed of with direction to the petitioners to surrender in the court below within a period of two weeks from the date of receipt of a copy of this order and produce the original challan, thereafter, the court below shall release the petitioners on provisional bail for a period of two months, during which period, the court below shall verify the authenticity of challan produced by the petitioner and if the same is found to be genuine, the court below shall confirm the provisional bail of the petitioners otherwise, the petitioners will have to surrender and pray for regular bail.
