JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-11-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in S. Kamal P.S. Case No. 93 of 2019, registered for the offences punishable under Section 376 of the Indian Penal Code and section 4 of the POCSO Act. It alleged that petitioner has committed rape upon the informant's daughter.

It is submitted by learned counsel appearing on behalf of petitioner that petitioner has falsely been implicated in this case. There is love affair between the petitioner and the victim girl. Petitioner is in custody since 05.04.2019 having clean antecedent.

In view of statement of victim girl under Section 164 Cr.P.C, I am not inclined to enlarge the petitioner on bail.

Patna High Court CR. MISC. No.63509 of 2019(3) dt.16-11-2019 2/2 Accordingly, the same is rejected.
