Informant, Banti Kumar Yadav, while was in way to the house over a motorcycle fallen victim at the hands of unknown criminals, who looted away his mobile as well as his motorcycle whereupon, case has been registered against unknown.

From the case diary, it is evident that some of the accused were apprehended relating to Madhepura P.S. Case No. 152/2019 (paragraph 71), who made inculpatory extra-judicial confessional statement and on the basis thereof, they have been remanded in this case. None of the accused has been put on T.I.P. There happens to be no recovery of motorcycle. However, the

No.56477 of 2019(3) dt.11-12-2019 2/2 police has unveiled the matter as is evident from para 80 of case diary wherefrom it is evident that an application filed by the informant before the S.P. was transmitted to the I.O. whereunder he claimed the identification of the accused but not of petitioner, which is found duly corroborated therefrom. The I.O. has mentioned the fact that informant had also arrived, who disclosed that during course of getting the accused at Madhepura Police Station, he had also arrived whom he had seen and out of four accused, he had identified Manish Kumar, Dhiren and Anmol. Petitioner is Om Prakash Kumar Mehta @ Master whose name did not find place.

Regard being had to the facts and circumstances of the case, petitioner Om Prakash Kumar Mehta @ Master @ Om Prakash Kumar @ Master is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura, in connection with Madhepura P.S. Case No. 187/2019.
