2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 387/34 of the Indian Penal Code.

3. According to the prosecution case, the petitioner is alleged to have demanded extortion money from the informant for granting permission to carry out the construction work. The petitioner also threatened the informant if he refused to fulfill the said demand.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to money dispute between the parties. As a matter of fact, the petitioner owns a

No.62650 of 2023(2) dt.22-09-2023 2/2 JCB machine which was rented by the informant and he was not paying dues of Rs. 50,000/- as a result of which, the present dispute broke out and the informant lodged the case against the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 20.7.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Vijaipur P.S. Case No. 76 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj.
