JUSTICE BIRENDRA KUMAR ORAL ORDER 29-06-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Sheikhpura P.S.Case No.370 of 2016 registered for the offences under Sections 147, 148, 149, 341, 323, 307, 386 and 506 of the Indian Penal Code.
The petitioner was member of unlawful assembly. Allegation against the unlawful members is of firing at the prosecution party as the informant had failed to fulfill the demand of ransom of Rs.1/- lac. Specific allegation of commission of injury is against unknown in the F.I.R. Further general and omnibus allegation is that all the miscreants took away Binod Sahni. One more witness has supported the allegation as disclosed in the F.I.R.
Submission of the learned counsel for the petitioner is
Patna High Court Cr.Misc. No.14142 of 2017 (3) dt.29-06-2017 that no overt act is alleged against the petitioner rather the allegation is of general and omnibus.
Considering the fact that there is allegation of firing against the petitioner though no firearm injury was sustained by anyone, nature of allegation of demand of ransom and abduction of Binod Sahni, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner is rejected.
