The Petitioner seeks bail in Sitamarhi P.S. Case No. 184 of 2014 instituted for the offence under Section(s) 147, 148, 149, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is not named in the written report. From the impugned order, it appears that in the supplementary Case Diary, in para 79, co-accused Viswajit Kumar @ Bittu on his arrest made confession before the police and stated the name of this petitioner. Thereafter the police arrested the petitioner as mentioned in para 7 of the second supplementary case diary and recorded the confession of the petitioner. The
Patna High Court Cr.Misc. No.14588 of 2017 (2) dt.20-04-2017 2/2 petitioner is said to be in custody since 12.04.2016. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 184 of 2014, subject to the conditions that both the bailors shall be the close relative of the petitioner.
