The petitioner seeks bail in connection with Hajipur Sadar P.S. Case No.44 of 2016 registered under Sections 392 and 411 of the Indian Penal Code.

The accusation is that the informant alongwith Vikash Kumar, after collecting the money, was going to the Bank for depositing the same. In the way, four persons, borne on two motorcycles, came and snatched Rs.12,100/- from the pocket of the informant and started to flee away but one of them was apprehended, who disclosed his name as Sanoj Rai, and he also disclosed the name of his three associates including the name of the petitioner, who succeeded to flee away.

No.13496 of 2017 (2) dt.07-04-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the name of the petitioner has been disclosed by the apprehended co-accused Sanoj Rai. The petitioner is in custody since 20.10.2016. While the occurrence is said to be of midday but the petitioner has not been put on T.I. Parade for identification. Further submission is that while the petitioner is accused in one more case, as detailed in paragraph-3 to this application, but in that case, the petitioner is on bail.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Anoop Singh, Judicial Magistrate, First Class, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No.44 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
