NILU AGRAWAL ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 12.01.2017 in connection with Banmankhi P.S. Case No. 10 of 2017 registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016. The allegation upon the petitioner, as per prosecution case, is that he was carrying eight litres of mahua wine on his motorcycle.

It has been submitted by the learned counsel for the petitioner that he is innocent, has no criminal history and has been falsely implicated by the villagers, as he was a painter and refused

Patna High Court Cr.Misc. No.10694 of 2017 (2) dt.15-03-2017 2/2 to paint the houses of the villagers.

However, learned A.P.P. for the State that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Banmankhi P.S. Case No. 10 of 2017.
