The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 504, 506, 427, 435 of the Indian Penal Code, 27 of the Arms Act and 3(1)(x) of SC/ST (Prevention of Atrocities) Act.
It is alleged that on 19.07.2014 at 11.00 P.M. in the night accused persons nine in numbers including the petitioner resorted to fire, demolished the hutment of the informant and set the hutment on fire when the villagers made protest then the informant was saved.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.36733 of 2015 (2) dt.10-09-2015 2/2 petitioner that the informant side are aggressors as the land in question belongs to the petitioner and proceeding under Section 107 Cr.P.C. was initiated earlier. There is counter version of the occurrence and petitioner has received injury in the incident when from the FIR it appears that no injury was caused to informant side.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Begusarai in connection with Begusarai SC/ST P.S. Case No. 45 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
