During the pendency of Title Appeal No. 38 of 2017 before the Additional District and Sessions Judge-IV, Saran, Chapra, a transfer petition has been filed by the petitioners on the ground that opposite party no.1 has uttered that he will get

Patna High Court C.Misc. No.505 of 2021(2) dt.11-05-2022 2/2 judgment in his favour by the court concerned. The learned District judge has rejected the transfer petition after finding the same to be baseless, frivolous and absurd.

From perusal of the contents of the order, it appears that except the allegation, there is no cogent material to corroborate the allegation I do not find merit in the present petition, which is accordingly dismissed.

The learned first appellate court is directed to provide proper opportunity to both the parties of being heard and thereafter decide the matter. The appeal shall be adjudicated upon as early as possible.
