The petitioner seeks bail in connection with registered under Sections 272, 273 of I.P.C. and Section 30(a), 37(a) of the Bihar Prohibition and Excise Act.

The accusation is that 410 bottles each containing 300 ml. of Nepalese soffy was recovered from the tempo which was being driven by Shiv Bahadur Kumar and the petitioner was sitting in that tempo.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated on mere

Patna High Court Cr.Misc. No.14218 of 2017 (2) dt.07-04-2017 suspicion in course of traveling in the tempo. The petitioner has no criminal antecedent. He is in jail custody since 25.01.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the S.D.J.M.,, Sikrahana at Dhaka, East Champaran, in Kundwachainpur P.S. Case No.9 of 2017.
