====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date : 27-07-2018 Heard learned counsel for the petitioner and counsel for the Food Corporation of India.

In the present case, the petitioner is making a prayer that he should be allowed to remain in the Eastern Region as his wife is a government employee.

From the records, it appears that on the request of the petitioner, he vide order dated 14.10.2014 was transferred to the Bihar region with a condition mentioned in the said letter that he was transferred for only three years, on completion of the aforesaid period of three years period, suo-motu he will join the original place of posting without delay but, as has been informed

Patna High Court CWJC No.10096 of 2018 dt.27-07-2018 2/2 by the counsel for the Food Corporation of India that already three years has completed in December, 2017 but, till date, he has not reported and has filed an application that he should be permanently allowed to stay in the State of Bihar. That is not acceptable to this Court. The petitioner must join there and report to the office and then he may file a representation for his transfer to the Eastern Region and the Chairman-cum-Managing Director, Food Corporation of India will consider the request of the petitioner and will take a decision in accordance with law.

If the petitioner files a representation before the Chairman-cum-Managing Director, Food Corporation of India, he will consider the same and pass orders within a period of eight weeks from the date of filing of the representation along with a copy of this order.

With the aforementioned observation and direction, this writ application is disposed of.
