Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 435, 379, 448, 380, 504 of the Indian Penal Code.

It is alleged that in the background of land dispute the petitioner assaulted on the head of the informant with iron rod.

It is submitted by learned counsel for the petitioner that accusation has been levelled in the background of a demarcation case pending between the parties. Moreover petitioner's side also lodged Maner P.S. Case No. 114 of 2015 on 27.03.2015 whereas the present F.I.R was registered on 24.04.2015. The injury of the informant has been found to be

Patna High Court Cr.Misc. No.36155 of 2015 (2) dt.08-09-2015 2/2 simple. There is counter version of the occurrence and there is no accusation of repeating the blow.

Considering the case lodged by the petitioner's side at earlier point of time and the injury of the informant being simple in nature, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur in connection with Maner P.S. Case No. 156 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
