JUSTICE BIRENDRA KUMAR ORAL ORDER 21-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 30(a)/38(1) of the Bihar Excise (Amendment) Act, 2016.
From the running train 96 liters of country-made liquor was allegedly recovered, which was of petitioner and other named accused persons.
Submission is that petitioner is in custody since 18.12.2016 and has stated on oath that he has got no criminal antecedent.
Considering the facts and circumstances, let petitioner, above named, be enlarged on bail after completion of four months of custody on furnishing bail bond of Rs.10,000/-
Patna High Court Cr.Misc. No.7722 of 2017 (2) dt.21-02-2017 2/2 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway Court, Kiul/Successor Court, in connection with Jhajha P.S. Case No. 137 of 2016.
