2. Having regard to the fact that the petitioner had moved this Court against an order of suspension passed by the authorities of the D.A.V. School and that during pendency of this writ application, he has already been dismissed from service, this writ application has obviously become infructuous, specially, when such writ application against the D.A.V. School is not at all maintainable in view of the judgment of this Court in the case of Santosh Kumar vs. The State of Bihar & Ors. reported in 2013(1)

3. As a matte of fact, if the petitioner has filed another writ application, being C.W.J.C. No. 6664 of 2015, against the order of dismissal from service again assailing the order of the authorities of the D.A.V. School even that writ application will not be maintainable but then this Court would not like to say any more about that writ application, save and except, learned counsel for the Respondents shall have liberty to bring this order to the notice of the court at the time of hearing of C.W.J.C. No. 6664 of 2015.
