JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor, for the State. This is an application for grant of regular bail to the petitioner. He is accused in Civil Lines P.S. Case No. 220 of 2016 registered for the offences under Section 414 of the Indian Penal Code and Sections 25(1-b) a/26/35 of the Arms Act. Allegation against the petitioner is that on 3rd of August, 2016, seeing the police, he along with co-accused Ajay Kumar Singh tried to flee away but apprehended and from his possession pistol and live cartridges were recovered. In paragraph No. 3 of the bail petition the petitioner has stated that he has no criminal antecedent. The petitioner was apprehended on 3rd of August, 2016 and charge

Patna High Court Cr.Misc. No.8603 of 2017 (4) dt.22-05-2017 2/2 sheet has been submitted against him.

In that view of the matter, I am inclined to enlarge the petitioner Raj Kumar Manjhi on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Civil Lines P.S. Case No. 220/2016 subject to the conditions that the petitioner will co-operate in the case and will not, in any manner, influence the witnesses.
