The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

It is alleged that this petitioner helped the owner and driver of the truck to flee away the truck while the truck was seized by the police and was kept outside the police station.

It is submitted by learned counsel for the petitioner that petitioner has no concern either with the seized truck or the owner or driver of the truck. The petitioner has falsely been implicated in this case.

No.71723 of 2021(2) dt.20-07-2022 2/2 Moreover, the owner and driver of the truck have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 13.06.2022 passed in Cr. Misc. No. 67442 of 2021. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S. Case No. 615 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
