Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Panapur PS case no. 08 of 2023, disclosing offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.

The prosecution case, in brief, according to the First Information Report, is that on 16.01.2023, the daughter of the informant had gone to attend nature's call but she did not return. Upon inquiry, the informant came to know that the petitioner along with other co-accused persons abducted the daughter of the informant.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to village

Patna High Court CR. MISC. No.64055 of 2023(2) dt.18-10-2023 2/2 politics. It is further submitted that the girl has been recovered and in her statement recorded under Section 164 Cr.P.C. before the learned Magistrate, she has not disclosed the name of the petitioner. It is also submitted that petitioner is having clean antecedent.

Regard being had to the submissions made on behalf of the parties and taking into consideration the statement of the victim girl recorded under Section 164 Cr.P.C. before the learned Magistrate as also the fact that the petitioner is having clean antecedent, I am inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Saran in connection with Panapur PS case no. 08 of 2023, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
