The Petitioner seeks bail in Janki Nagar P.S. Case No. 45 of 2016, arising out of Sessions Trial No. 463 of 2016, pending in the Court of learned Vth Additional District & Sessions Judge, Purnea instituted for the offence under Section(s) 302, 120B/34 of the Indian Penal Code.
The petitioner is husband of the deceased.
As per written report, the petitioner had illicit relationship with the wife of the elder brother which was objected by the daughter of the informant on account of which he always used to have altercation with her. On the alleged date of occurrence when the daughter of the informant raised objection,
Patna High Court Cr.Misc. No.14709 of 2017 (3) dt.09-05-2017 2/2 he committed her murder by strangulation.
The case diary has been received.
Learned A.P.P. after going through the case diary has submitted that in the postmortem report, the doctor has found cause of death as asphyxia due to throttling. As there is specific allegation against this petitioner of causing death of his wife by strangulation which also gets corroborated with the postmortem report, this Court is not inclined to grant bail to the petitioner at this stage. The prayer of the petitioner for grant of bail is rejected. The Trial Court is directed to expedite the trial. (Sanjay Priya, J) Shageer/- U T
