2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 363,366A/34 of the Indian Penal Code.

3. As per the prosecution case, FIR named accused persons kidnapped minor daughter of the informant for marriage or to sell her.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on suspicion. He is not named in the FIR. Victim in her 164 Cr.P.C. statement has made specific accusation against co-accused Rajnish Kumar and this petitioner is only alleged to have facilitated commission of offence. The victim has not alleged anything wrong against the petitioner.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI cum Special Judge, POCSO Act, Sitamarhi in Riga Police Station Case No. 190 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
