2. The petitioner apprehends arrest in connection with Baligaon PS Case No.118 of 2020 dated 04.10.2020, instituted under Sections 363, 366-A/34 of the Indian Penal Code.

3. It is alleged that the petitioner along with others have kidnapped twelve years old daughter and 15 years old niece of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is further submitted that there is nothing against the petitioner in the statement of the victim recorded under Section 164 Cr. P.C. on 13.01.2022.

5. Learned APP has opposed the prayer for bail. It is

Patna High Court CR. MISC. No.61428 of 2023(3) dt.13-12-2023 2/2 submitted that statement of one of the victim, namely, Payal Kumari was recorded under Section 164 Cr.P.C. in which there is specific allegation of kidnapping against the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, I am not inclined to extend the privilege of anticipatory bail to the petitioner.
