Petitioner is apprehending his arrest in connection with Silao P.S.Case no.192/18 , registered for offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the FIR, it appears that some altercation in between the children took place in the school and it is alleged that when the father of Shalu Kumari and and Nikki Kumari went to the house of one Bablu Kumar to make complaints he fired on the father of the informant causing injury to him. So far this petitioner is concerned there is allegation that they surrounded the deceased.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.56662 of 2019(4) dt.06-11-2019 2/2 that the police after investigation has submitted final form not finding the case true against him and the cognizance of the offence has been taken and moreover there is no allegation of firing on the petitioner.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda at Biharsharif in connection with Silao P.S.Case No.192 of 2018 dated 31.8.2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
