2. In nature of prayer made in the modification application, the Court is not inclined to entertain the same as the Court is taking consistent view that if the accused has not surrendered within the time frame in that event the time is not being extended for surrendering, if the modification application has not been filed prior to the date of surrender coming to an end.

3. Accordingly, the modification application is dismissed.
