This is an application for bail in connection with Barauni P.S.Case No. 344 of 2016 registered for the offences punishable under Sections 379 and 427 of the Indian Penal. It has been submitted on behalf of the petitioner that petitioner is not named in the FIR and later on on the basis of confessional statement he has been made accused in this case ahd he is in custody since 26.9.2016.

Heard learned APP also, who has opposed the prayer for bail stating that on the basis of confessional statement Rs.2 lacs has been recovered from the house of the petitioner along with some incriminating articles.

Having heard both sides and considering the facts and

Patna High Court Cr.Misc. No.8036 of 2017 (2) dt.23-02-2017 2/2 circumstances of the case, I am not inclined to grant bail to the petitioner.

However, trial court is directed to conclude the trial within a period of six months. If the trial is not concluded within the said period, the petitioner will be at liberty to renew his prayer for bail before the court below itself, who will consider the same on the basis of materials on the record.

Accordingly, this application is dismissed.
