The petitioner has preferred this application for grant of regular bail in a case registered under sections 392 and 411 of the Indian Penal Code.

As per the prosecution case, three accused persons looted the informant of his scooty, however, on hulla being raised the accused persons were surrounded by the persons working in the agricultural field, the scooty recovered and the accused persons including the petitioner herein were caught at the spot.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case under a misunderstanding. No occurrence as alleged has taken place.

Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal antecedent, his having remained in custody since 7.8.2021 and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Naya Gaon P.S. Case no. 138 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Saran at Chapra.
