The petitioners are in custody in connection with Lauriya P.S.Case No.223 of 2016 registered for an offence under Sections 341, 342, 448, 323, 324, 307, 379 and 506/34 of the IPC. Petitioners and informant are Pattidars and on the date of occurrence both parties indulged in scuffle for a land dispute. There is case and counter case between the parties. The petitioners claim that they also sustained injuries in the said scuffle. The injury report shows that the informant sustained two injuries which are lacerated wound and bruise around/below left eye. The allegation of causing Dabiya below is against co-accused Chandradeo Mahto who is not the petitioner before this Court. The
Patna High Court Cr.Misc. No.6007 of 2017 (2) dt.22-02-2017 2/2 wife of petitioner no.2 has also lodged police case no.226 of 2016 against the present informant and his family members. The petitioners are in custody since 11.12.2016.
Considering the nature of allegation, length of custody as also the fact a counter case has also been lodged for the same offence, let the above named two petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM-Ist, Bettiah in connection with Lauriya P.S.Case No.223 of 2016.
