JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 24-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioners seek bail in connection with Bihta P.S. Case No.516 of 2016 registered under Sections 498(A), 304(B) and 120-B of the Indian Penal Code besides Sections 3 and 4 of the Dowry Prohibition Act.

The allegation of the informant Asha Devi is that her daughter Rani Devi was being tortured by her husband and in-laws for non fulfillment of the dowry demand of cash Rs.2,00,000/-, gold chain etc. On 23.07.2016, at about 08.00 A.M., in the morning, Shambhu Sao, the father-in-law of her daughter,

No.9282 of 2017 (3) dt.24-03-2017 2/3 informed on the mobile of the husband of the informant that her daughter has been burnt and she was admitted at Ramanand Hospital, Bariyaon, for treatment. Thereafter, the informant alongwith her husband and son went to Ramanand Hospital, Bariyaon, to see her, where the daughter of the informant denoted her finger about causing injury to her by her husband and in-laws. Rani Devi, the daughter of the informant, was rushed to Apolo Burn Hospital from Ramanand Hospital, Bariyaon for better treatment, where she died on 27.07.2016.

Learned counsel appearing on behalf of the petitioners submits that, in fact, the deceased Rani Devi, the daughter of the informant, sustained burn injury in course of cooking meal and she was rushed to the hospital for treatment and information in this regard was given to the husband of the informant by Shambhu Sah, the father-in-law of the deceased Rani Devi, the daughter of the informant, but with an ulterior motive, after the death of the deceased Rani Devi, the daughter of the informant, on 27.07.2016, the present case was lodged. Further submission is that the petitioners are brother-in-law (dewar) and mother-in-law respectively of the deceased Rani Devi, the daughter of the informant. The petitioners are in jail custody since 02.08.2016. The husband of the deceased Rani Devi, the daughter of the

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Danapur, Patna, in connection with Bihta P.S.
