Petitioner apprehends arrest in registered for the offences punishable under Sections 420, 120B and other allied sections of the Indian Penal Code and Sections 30(a), 32(1)(iii), 36, 41(1)(ii) of Bihar Prohibition and Excise Act, 2018. As per prosecution case, 661.14 liters of illicit liquor was recovered from truck of which petitioner is registered owner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner.

Learned counsel for the State opposes the prayer for bail application submitting that petitioner is owner of the

Patna High Court CR. MISC. No.60003 of 2022(2) dt.09-12-2022 2/2 vehicle in question and he has got 1 criminal antecedent of similar nature.

Considering the criminal antecedent of similar nature, huge quantity of recovery from the vehicle of the petitioner, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
