JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Petitioner is languishing in custody since 02.07.2014 in a case registered for the offences punishable under Section 395 of the I.P.C.

Accusation is robbing the Bolero vehicle. The name of the petitioner sprang up on confession of the coaccused. Subsequently the petitioner made confession before the police.

It is submitted by learned counsel for the petitioner that nothing has been recovered from the possession of the petitioner and the recovery has been made from one Baskat Jha. It is further submitted that petitioner has not been put on T.I.P.

Considering the fact that petitioner has not been put on T.I.P, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of

Patna High Court Cr.Misc. No.40333 of 2014 (3) dt.16-01-2015 2/2 learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 164 of 2013. Since petitioner has criminal antecedent, let learned Court below cancel the bail bonds of the petitioner, if the petitioner defaults for two consecutive occasions during trial.
