The petitioner apprehends his arrest in Sherghati P.S. Case No. 65 of 2020, registered for the offences punishable under Section 379 and other allied sections of the Indian Penal Code.

As per the allegation petitioner along with co-accused persons used to commit theft of motorcycle and sell the same. It is submitted that petitioner has been made accused in this case on the basis of confessional statement of co-accused persons. No stolen article has been recovered from possession of this petitioner. On the alleged date and time of occurrence this petitioner was in custody in connection with Gurua PS Case No.

Patna High Court CR. MISC. No.71126 of 2021(2) dt.19-07-2022 2/2 50 of 2008.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Sherghati P.S. Case No. 65 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
