JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-09-2019 The petitioner claims to be the second widow of late Sohendra Yadav, who is said to have died in harness while serving as Constable on 30.12.2015. The petitioner claims that her son is entitled for appointment on compassionate ground who shall attain the qualifying age of 18 years on 24.6.2020. This writ application has been filed seeking direction to the Respondents to consider the case of petitioner's son for his appointment on compassionate ground, after he attains the qualifying age.

Admittedly, the petitioner's son does not have the basic qualification for appointment on compassionate ground. The direction, which the petitioner is seeking, cannot be issued by this Court in such circumstances.

Patna High Court CWJC No.18302 of 2019(2) dt.19-09-2019 2/2 Learned counsel for the petitioner seeks permission to withdraw this application with a liberty to approach the authorities, once the petitioner's son attains the age of 18 years. In view of the submission made on behalf of the petitioner, this writ application is dismissed as withdrawn with a liberty to the petitioner to approach competent authority at appropriate time. It is indicated that before considering the claim of the petitioner for compassionate appointment, the authorities will have to be satisfied that the person, in whose favour the petitioner is seeking appointment on compassionate ground, is son of the deceased employee.
