The petitioner apprehends his arrest in Adapur P.S. Case No. 254 of 2021, registered for the offences punishable under Section 28(i)(a) of the Fertilizer Control Order 1985 and section 7(i)(9)(i) of the Essential Commodities Act. As per the FIR, petitioner was found indulged in black marketing of fertilizers and selling the same at higher price. It is submitted that petitioner has been falsely implicated in this case. No case under Fertilizer Control Order 1985 or under EC Act is made out against the petitioner. Allegation leveled against the petitioner is false and concocted and is not corroborated by the receipt and stock showing in the Godown of petitioner. Petitioner claims clean antecedent.

No.71096 of 2021(2) dt.19-07-2022 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari in connection with Adapur P.S. Case No. 254 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
