The petitioner is languishing in custody for the offence punishable under Section 376/34 of the Indian Penal Code in connection with Manihari P.S. Case No. 208 of 2018. Allegation against the petitioner is of commission of rape against the informant. The informant has supported the aforesaid allegation in her statement under Section 164 Cr.P.C. also. Though she stated that the petitioner was known to her as the petitioner was her neighbour.

Submission is that the matter is of love affairs and the prosecution case does not find corroboration from the medical evidence. Petitioner is in custody since 29.06.2019.

Patna High Court CR. MISC. No.61457 of 2019(3) dt.18-12-2019 2/2 Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail for the present. Hence, the prayer for bail is refused.
