JUSTICE BIRENDRA KUMAR ORAL ORDER 27-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

The F.I.R. named accused persons including one Arvind Kumar @ Arvind Kumar Singh, father's name not known; of village of the informant allegedly committed murder of his brother. The informant is resident of village Singthi, police station Bhabhua, district- Kaimur, whereas petitioner is resident of village- Akhlashpur, P.S. Bhabua, District- Kaimur. Submission is that there is no other eyewitness and some other co-accused have already been allowed bail by a

Patna High Court Cr.Misc. No.8582 of 2017 (3) dt.27-03-2017 2/2 coordinate Bench of this Court. Petitioner has stated on oath that he has got no criminal antecedent.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua/Successor Court, in connection with Bhabua P.S. Case No.623 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case. At the time of furnishing of the bail-bonds, the learned Court-below shall verify that the petitioner is residents of village-Akhlashpur, police station- Bhabhua, district- Kaimur.
