JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-11-2017 Heard Mr. Suraj Narain Sinha, learned Senior Counsel for the petitioner and Mr. J.N. Thakur, learned APP. The petitioner being the husband of the victim has renewed his prayer for bail in a case registered for the offences punishable under Sections 498A and 304B/34 of the IPC. The prosecution case is of killing the daughter of the informant after about two and half years of marriage for nonfulfillment of the dowry demand of Rs. 5 lacs by causing burn injury.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the victim Gunja Kumari and birth of a female child. The victim was slightly mentally abrased and had suicidal tendency for which she was being
Patna High Court Cr.Misc. No.3363 of 2017(2) dt.15-11-2017 2/2 provided medical assistance. The petitioner was employed in armed force, precisely, Assam Rifles. The informant's side is filing frivolous applications either for recall of witness or for adding some more persons as accused.
The report of the S.P., Buxar, dated 18.08.2017 reflects that all the ten charge-sheeted witnesses have been examined on behalf of the prosecution.
It is submitted by learned counsel for the informant that four defence witnesses have already been examined. He further undertakes that the informant will not file any frivolous application during trial.
In view of the present stage of the trial, this Court is not inclined to interfere.
However, it is expected from the learned Additional Sessions Judge, FTC-II, Buxar to conclude the trial of S. Tr. No. 177 of 2016, arising out of Buxar (M) P.S. Case No. 311 of 2015.
