JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-01-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner seeks bail in a case for the offences punishable under sections 272 and 273 of the I.P.C. and 30(a) of the Bihar Excise Amendment Act.

Allegedly the petitioner sold liquor which was recovered from the pocket of co-accused and thereafter the shop of the petitioner was also searched and from there 1.8 litres foreign liquor was recovered from his shop as per seizure list. Submission is of false implication and that the petitioner is suffering in custody since 17.11.2016 having no criminal antecedent and he deserves sympathetic consideration. The learned APP opposes the prayer of bail.

No.2142 of 2017 (2) dt.25-01-2017 2/2 In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Motihari, East Champaran in Pipra P.S. Case No. 194 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
