The petitioner seeks bail in connection with S.Tr.No.796/16 arising out of Deoria P.S. Case No.51/14 registered under Sections 302, 201/34, 364 of the Indian Penal Code.
The allegation of the informant, Ranjan Kumar Sah, is that on 2.6.2014 his mother, Uma Devi, went with four persons namely, Raju Sah, Dharmendra Sah, Jata Rai and the petitioner Amarjeet Sah for execution of the sale deed with cash Rupees two lacs. While the mother of the informant talked to him on reaching Deoria. Thereafter informant tried to talk to his mother, but he could not succeeded in talking. He raised suspicion about
Patna High Court Cr.Misc. No.7378 of 2017 (3) dt.12-04-2017 2/2 committing murder of his mother by the aforesaid four persons including the petitioner.
Learned counsel for the petitioner submits that, in fact, prior to the present occurrence the father of the petitioner was murdered by administering poison by the informant for which Kalyanpur P.S.Case No.142/13 was lodged by the brother of the petitioner, Raju Sah, for the offence under Section 328/202/34 of the I.P.C. on 17.07.2013. In course of investigation Lakshmi Sah who claims to be an eye witness has not named this petitioner in his statement recorded under Section 164 Cr.P.C.rather he has stated that Jata Sah and Girija Sah have committed murder of Uma Devi Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-1st, Muzaffarpur, in connection with S.Tr.No.796/16 arising out of Deoriya P.S.Case No.51/14.
