2. By the impugned order dated 03.06.2013 passed in Goreakothi P.S.Case No.37 of 2009, the learned S.D.J.M., Siwan has refused to discharge the petitioner under Section 239 Cr.P.C.

3. According to FIR, a Marshall Jeep was recovered from near the Hardware shop of the petitioner. The people therein informed that the vehicle was of the petitioner and subsequently it revealed that the same was of stolen vehicle. Later on, the District Transport Officer informed to the learned C.J.M. Siwan that the vehicle is registered in the name of Ranjeet Kumar Singh. Thus the vehicle was released in favour of Ranjeet Kumar Singh.

4. The impugned order reveals that the learned C.J.M. has considered the material on the record to reject the

Patna High Court CR. MISC. No.37049 of 2015 dt.13-01-2020 2/2 prayer of discharge. The trustworthiness of the material cannot be looked into at the stage of hearing on charge.
